5		INSTALLATI ON AND USE RIGHTS.
6		General. Y ou may ins tall and u se any num ber of cop ies of the software to develop and test your appli cations.
7		Third Part y Software . The soft ware may i nclude thi rd party a pplication s that Mic rosoft, no t the thir d party, l icenses to you under this agre ement. Any included notices fo r third pa rty applic ations are for your informatio n only.
8		DISTRIBUTA BLE CODE. The softwa re may con tain code you are pe rmitted to distribut e (i.e. ma ke availab le for thi rd parties ) in appli cations yo u develop, as descri bed in thi s Section.
9		Distributi on Rights. The code and test f iles descr ibed below are distr ibutable i f included with the software.
10		Sample Cod e. You may copy, mod ify, and d istribute the source and objec t code for m of code marked as “sample”.
11		Other Dist ributable Code. You may copy a nd distrib ute the ob ject code form of co de if it i s a file w ith the ex tension *. dll.
12		Icons. You may copy and distri bute the i cons in th e Image Li brary as d escribed i n the soft ware docum entation.
13		Image Libr ary. You m ay copy an d distribu te images and animat ions in th e Image Li brary as d escribed i n the soft ware docum entation. You may al so modify that conte nt. If you modify th e content, it must b e for use that is co nsistent w ith the pe rmitted us e of the u nmodified content.
14		Third Part y Distribu tion. You may permit distribut ors of you r applicat ions to co py and dis tribute an y of this distributa ble code y ou elect t o distribu te with yo ur applica tions.
15		Distributi on Require ments. For any code you distri bute, you must:
16		add signif icant prim ary functi onality to it in you r applicat ions;
17		require di stributors and exter nal end us ers to agr ee to term s that pro tect it an d Microsof t at least as much a s this agr eement; an d
18		indemnify, defend, a nd hold ha rmless Mic rosoft fro m any clai ms, includ ing attorn eys’ fees, related t o the dist ribution o r use of y our applic ations, ex cept to th e extent t hat any cl aim is bas ed solely on the unm odified di stributabl e code.
19		Distributi on Restric tions. You may not:
20		use Micros oft’s trad emarks or trade dres s in your applicatio n in any w ay that su ggests you r applicat ion comes from or is endorsed by Microso ft; or
21		modify or distribute the sourc e code of any distri butable co de so that any part of it beco mes subjec t to any l icense tha t requires that the distributa ble code, any other part of th e software , or any o f Microsof t’s other intellectu al propert y be discl osed or di stributed in source code form, or that o thers have the right to modify it.
22		SCOPE OF L ICENSE. Th e software is licens ed, not so ld. Micros oft reserv es all oth er rights. Unless ap plicable l aw gives y ou more ri ghts despi te this li mitation, you will n ot (and ha ve no righ t to):
23		work aroun d any tech nical limi tations in the softw are that o nly allow you to use it in cer tain ways;
24		reverse en gineer, de compile, o r disassem ble the so ftware, or attempt t o do so, e xcept and only to th e extent p ermitted b y licensin g terms go verning th e use of o pen-source component s that may be includ ed with th e software ;
25		remove, mi nimize, bl ock, or mo dify any n otices of Microsoft or its sup pliers in the softwa re;
26		use the so ftware in any way th at is agai nst the la w or to cr eate or pr opagate ma lware; or
27		share, pub lish, dist ribute, or lend the software ( except for any distr ibutable c ode, subje ct to the terms abov e), provid e the soft ware as a stand-alon e hosted s olution fo r others t o use, or transfer t he softwar e or this agreement to any thi rd party.
28		EXPORT RES TRICTIONS. You must comply wit h all dome stic and i nternation al export laws and r egulations that appl y to the s oftware, w hich inclu de restric tions on d estination s, end use rs, and en d use. For further i nformation on export restricti ons, visit (aka.ms/e xporting).
29		SUPPORT SE RVICES. Mi crosoft is not oblig ated under this agre ement to p rovide any support s ervices fo r the soft ware. Any support pr ovided is “as is”, “ with all f aults”, an d without warranty o f any kind .
30		UPDATES. T he softwar e may peri odically c heck for u pdates, an d download and insta ll them fo r you. You may obtai n updates only from Microsoft or authori zed source s. Microso ft may nee d to updat e your sys tem to pro vide you w ith update s. You agr ee to rece ive these automatic updates wi thout any additional notice. U pdates may not inclu de or supp ort all ex isting sof tware feat ures, serv ices, or p eripheral devices.
31		TERMINATIO N. Without prejudice to any ot her rights , Microsof t may term inate this agreement if you fa il to comp ly with an y of its t erms or co nditions. In such ev ent, you m ust destro y all copi es of the software a nd all of its compon ent parts.
32		ENTIRE AGR EEMENT. Th is agreeme nt, and an y other te rms Micros oft may pr ovide for supplement s, updates , or third -party app lications, is the en tire agree ment for t he softwar e.
33		APPLICABLE LAW AND P LACE TO RE SOLVE DISP UTES. If y ou acquire d the soft ware in th e United S tates or C anada, the laws of t he state o r province where you live (or, if a busi ness, wher e your pri ncipal pla ce of busi ness is lo cated) gov ern the in terpretati on of this agreement , claims f or its bre ach, and a ll other c laims (inc luding con sumer prot ection, un fair compe tition, an d tort cla ims), rega rdless of conflict o f laws pri nciples. I f you acqu ired the s oftware in any other country, its laws a pply. If U .S. federa l jurisdic tion exist s, you and Microsoft consent t o exclusiv e jurisdic tion and v enue in th e federal court in K ing County , Washingt on for all disputes heard in c ourt. If n ot, you an d Microsof t consent to exclusi ve jurisdi ction and venue in t he Superio r Court of King Coun ty, Washin gton for a ll dispute s heard in court.
34		CONSUMER R IGHTS; REG IONAL VARI ATIONS. Th is agreeme nt describ es certain legal rig hts. You m ay have ot her rights , includin g consumer rights, u nder the l aws of you r state or country. Separate a nd apart f rom your r elationshi p with Mic rosoft, yo u may also have righ ts with re spect to t he party f rom which you acquir ed the sof tware. Thi s agreemen t does not change th ose other rights if the laws o f your sta te or coun try do not permit it to do so. For examp le, if you acquired the softwa re in one of the bel ow regions , or manda tory count ry law app lies, then the follo wing provi sions appl y to you:
35		Australia. You have statutory guarantees under the Australia n Consumer Law and n othing in this agree ment is in tended to affect tho se rights.
36		Canada. If you acqui red this s oftware in Canada, y ou may sto p receivin g updates by turning off the a utomatic u pdate feat ure, disco nnecting y our device from the Internet ( if and whe n you re-c onnect to the Intern et, howeve r, the sof tware will resume ch ecking for and insta lling upda tes), or u ninstallin g the soft ware. The product do cumentatio n, if any, may also specify ho w to turn off update s for your specific device or software.
37		Germany an d Austria.
38		(i)Warrant y. The pro perly lice nsed softw are will p erform sub stantially as descri bed in any Microsoft materials that acco mpany the software. However, M icrosoft g ives no co ntractual guarantee in relatio n to the l icensed so ftware.
39		(ii)Limita tion of Li ability. I n case of intentiona l conduct, gross neg ligence, c laims base d on the P roduct Lia bility Act , as well as, in cas e of death or person al or phys ical injur y, Microso ft is liab le accordi ng to the statutory law.
40		Subject to the foreg oing claus e (ii), Mi crosoft wi ll only be liable fo r slight n egligence if Microso ft is in b reach of s uch materi al contrac tual oblig ations, th e fulfillm ent of whi ch facilit ate the du e performa nce of thi s agreemen t, the bre ach of whi ch would e ndanger th e purpose of this ag reement an d the comp liance wit h which a party may constantly trust in (so-called "cardinal obligatio ns"). In o ther cases of slight negligenc e, Microso ft will no t be liabl e for slig ht neglige nce.
41		DISCLAIMER OF WARRAN TY. THE SO FTWARE IS LICENSED “ AS IS.” YO U BEAR THE RISK OF U SING IT. M ICROSOFT G IVES NO EX PRESS WARR ANTIES, GU ARANTEES, OR CONDITI ONS. TO TH E EXTENT P ERMITTED U NDER APPLI CABLE LAWS , MICROSOF T EXCLUDES ALL IMPLI ED WARRANT IES, INCLU DING MERCH ANTABILITY , FITNESS FOR A PART ICULAR PUR POSE, AND NON-INFRIN GEMENT.
42		LIMITATION ON AND EX CLUSION OF DAMAGES. IF YOU HAV E ANY BASI S FOR RECO VERING DAM AGES DESPI TE THE PRE CEDING DIS CLAIMER OF WARRANTY, YOU CAN R ECOVER FRO M MICROSOF T AND ITS SUPPLIERS ONLY DIREC T DAMAGES UP TO U.S. $5.00. YO U CANNOT R ECOVER ANY OTHER DAM AGES, INCL UDING CONS EQUENTIAL, LOST PROF ITS, SPECI AL, INDIRE CT, OR INC IDENTAL DA MAGES.
43		This limit ation appl ies to (a) anything related to the softw are, servi ces, conte nt (includ ing code) on third p arty Inter net sites, or third party appl ications; and (b) cl aims for b reach of c ontract, w arranty, g uarantee, or conditi on; strict liability , negligen ce, or oth er tort; o r any othe r claim; i n each cas e to the e xtent perm itted by a pplicable law.
44		It also ap plies even if Micros oft knew o r should h ave known about the possibilit y of the d amages. Th e above li mitation o r exclusio n may not apply to y ou because your stat e, provinc e, or coun try may no t allow th e exclusio n or limit ation of i ncidental, consequen tial, or o ther damag es.
